This Agreement defines the terms of your use of this Website and all services and purchases therethrough. Your viewing or use of this Website constitutes your agreement to abide by the provisions of this Agreement. If you do not agree with any provision of this Agreement, you must exit this Website immediately.
General Terms
HotRussianBrides.com (the "Website") is an international online service operated by Romantic Tours, Inc. ("RTI") a Florida corporation. I-Pay Global, Inc., an RTI international affiliate, may appear on some credit card statements. Whether you are accessing the Website as an anonymous unregistered visitor (hereinafter "Guest"), you are a male who has registered and established a profile on one of RTI's affiliated websites for males (hereinafter "Member"), you are a female Foreign National Client registered on one of RTI's affiliated foreign websites (hereinafter "FNC"), or, you are a foreign agency working in cooperation with RTI or one of its affiliates to provide services between Members and FNCs (hereinafter "Agency") and you are participating in HotRussianBrides.com's services, including but not limited to, email messaging, live instant messaging, live video streaming, and gift delivery ("Services"), you must agree to abide by the General Terms, the User Agreement, the Disclaimer, and the Privacy Policy (collectively the "Agreement") herein.

Use of "you", "your", "yourself", "he", "him", "himself", "she", "her", "herself", "they", "their", "them", or "user(s)", refers to Guests, Members, FNCs, or Agencies either separately, in various combinations, or collectively depending on context. All users use of the Website inherently conveys their agreement to abide by the provisions of this Agreement. Additionally, all users are required to abide by all policies, procedures, rules, and regulations established by RTI that are currently in use or as they may be adopted at anytime hereafter. Any of the provisions contained in this Agreement may be amended, revised, or added to without prior notice and become effective and enforceable as of the date such amendment, revision, or addition is made. It is each user's sole obligation and responsibility to periodically review all provisions contained in this Agreement.

Lawful Use and Eligibility. The Website may be used for lawful purposes only. If you are a Guest or a Member, you are at least 21 years of age, you have not been convicted of a misdemeanor, felony, or pleaded nolo contendre for crimes in category "A" involving homicide, murder, manslaughter, rape, abusive sexual contact, sexual exploitation, incest, torture, trafficking, peonage, holding hostage, involuntary servitude, slave trade, kidnapping, abduction, unlawful criminal restraint, false imprisonment, or an attempt to commit any of these crimes, or you have not been convicted of a felony (or pleaded nolo contendre to a felony charge) for crimes in category "B" involving domestic violence, domestic assault, sexual assault, dating violence, stalking, child abuse and neglect, and/or elder abuse. If you are an FNC, you are at least 18 years of age and you have not been convicted of a crime. If you are an Agency, you agree to all the applicable terms in this Agreement as well as additional Agency terms. Eligibility to use or participate in the Services available on the Website is denied to any user whom RTI has knowledge does not meet these eligibility requirements (see "NOTICE TO FNCs" and "NOTICE TO MEMBERS" below regarding knowledge by RTI and "Safety Awareness" below regarding the fact that RTI DOES NOT CONDUCT CRIMINAL BACKGROUND SCREENINGS except as Maryland or other applicable law may require). BY ACCESSING THE WEBSITE, YOU HEREBY ATTEST THAT YOU MEET THE ELIGIBILITY REQUIREMENTS IMMEDIATELY ABOVE.

Important Information. In compliance with the United States Violence Against Women and the Department of Justice Reauthorization Act of 2005 ("H.R. 3402") which contains the International Marriage Broker Regulation Act of 2005 ("IMBRA"), all users' agreement to comply with IMBRA is a precondition to any Services provided by RTI and its affiliates, whether those Services are secured through RTI websites, agents, employees, or by any other means. Additionally, all users agree to comply with any state law requirements which may include additional steps such as the securing of official criminal history record information by the Member himself and forwarding such information to RTI. RTI will forward such information to any FNC with which the Member has requested direct contact. All users give RTI express permission to complete whatever requirements the state in which they reside may require for them to participate in the Services.

All Members, FNCs, and/or Agencies who utilize or participate in the Services agree to abide by the provisions of IMBRA. Any act or attempt, either willful or inadvertent, on the Member's part solely, or in concert with an FNC, an Agency, or in concert with another online service, whether of domestic or foreign registry, to circumvent the information notification and release provisions of IMBRA, is a violation of the law and therefore in violation of this Agreement. All Members, FNCs, and Agencies agree to assume full responsibility personally and to indemnify and hold harmless RTI from any criminal or civil liability associated with such acts or attempts.

Generally speaking, but not necessarily inclusive, Members who reside in the United States or who are United States citizens, that become interested in obtaining personal contact information or in arranging in-person meetings with FNCs, are prohibited from having any direct communications with those FNCs until full compliance with the IMBRA information notification and release provisions have been fulfilled. Generally speaking, but not necessarily inclusive, FNCs are women who list their profiles on the Website, reside outside the United States, and are not United States citizens. NOTE: IMBRA regulations are gender neutral. The definitions of users in this Agreement are in no way intended to be exclusionary but are only intended to reflect typical user interactions.

The following is an overview of the steps RTI requires Members and FNCs to complete before RTI will participate in facilitating direct communication between a Member and an FNC via the HotrussianBrides.com "Intimacy Request" [Direct Communication Services] option. Direct Communication Services means the Member and FNC can communicate through the Website without filters and exchange personal contact information if desired. However, the sale of FNC contact information is NOT a service of RTI. Even after fully complying with the IMBRA information notification and release provisions, the information released by an FNC is ultimately at the total discretion of the FNC. RTI makes no representation or warranty as to what information, if any, an FNC will be willing to provide at any given time or in any given circumstance. In addition to the following steps, RTI, at its sole discretion and without prior notice, may implement additional steps, policies, procedures and requirements governing direct contact between Members and FNCs whether or not such steps, policies, procedures and requirements are required by IMBRA.

Step 1. To begin the process for Direct Communication Services, a Member must click the "IMBRA" button in the bottom border. The Member will first be instructed to complete the Acknowledgement of Services Received Form ("ASR"). The purpose of the ASR is to protect RTI from instances of credit card fraud. This single page electronic form takes just a few moments to read and acknowledge. After completing the ASR the Member will be required to complete the Client Attestation Form ("CA"). The electronic CA can be completed in just a few minutes. It contains several questions regarding a Member's background. Additional information or steps may be required depending upon the Member's state of residence.

To offset the costs RTI incurs to process and maintain a secure translated copy of the CA, Members will be charged a fee. Once a Member fills out the CA in its entirety and clicks the "Submit" button, he will be directed to a secure purchase page where he will be required to enter billing information. Upon payment RTI will begin processing the CA form. There are no refunds for any reason once a Member submits the CA form and pays for processing regardless of the outcome. If at any future date the CA requires any updates, such as changes of address, the CA will be reprocessed at no additional charge.

Some states may require additional steps that the Members must complete at their own expense. Some states provide for the FNC to request additional information (See "NOTICE TO FNCs" below) which if requested, the Member must complete to be approved for Direct Communication Services.

After completing all required federal and state requirements, the Member's documents will be reviewed. During the review period, the CA and any supporting documents will be translated and scanned into a secure area of the Member's profile where they will be stored. The CA and supporting documents will be made viewable only to FNCs with whom the Member requests Direct Communication Services.

NOTE: Any Member who has been convicted or pleaded nolo contendre to a misdemeanor for any of the crimes listed in category "B" in the "Lawful Use and Eligibility" section of this Agreement, will be required to forward documentation regarding the particulars of the conviction including the court record at the time they submit their CA. Members are hereby notified that all such documentation will be made available along with the Member's CA and any state required documents to FNCs with whom the Member requests Direct Communication Services. If desired, Members may provide a statement of explanation regarding a conviction in category B that will also be forwarded with the CA and its documentation.

However, whether or not a Member supplies all requested documentation and/or meets the eligibility requirements in the "Lawful Use and Eligibility" section of this Agreement, access (or the denial of access) to the Website remains at RTI's sole discretion, which RTI may exercise at any time without explanation of reason or cause. If RTI determines at any time that it will not allow continued access to the Website to an existing Member, such Member shall not be entitled to any refund for Services utilized by the Member prior to such determination by RTI.

Step 2. After review and acceptance of the CA and all documentation provided by the Member and any documentation provided by any state or federal agency, a new orange "Intimacy Request" icon will appear in the FNCs' profile cards in place of the Intro Letter icon. A Member can "click" on any Intimacy Request icon in an FNC's profile card to request Direct Communication Services with her. The icon will turn grey indicating the request is pending.

Step 3. An automated email will be sent to the FNC with whom a Member has requested Direct Communication Services alerting her of the Member's request. For our Members' protection, the translated CA and other documentation forwarded to FNCs will only identify the Member by his profile ID number. In order to facilitate your request in the quickest amount of time possible, a duplicate notification will also be sent to the FNC's agency.

Upon receipt of a Member's request, the FNC will be instructed to login to the Website in order to access the translated version of the CA and any addition support or requested documentation. After reviewing the CA and documents of the Member the FNC will either "approve" or "deny" the request for her to participate in Direct Communication Services with the Member. If she approves the request, the FNC will be required to sign a release form confirming receipt of the requesting Member's CA, documents and the USCIS Fact Sheet. After she does so, the Member will receive an email notification of the approval and the Intimacy Request button in the FNC's profile will turn green. If the FNC denies the request, the Member will receive an email notification and the Intimacy Request button in the FNC's profile will turn red.

A member's account will be charged 100 credits for each Intimacy Request. If the FNC denies the request, the 100 credits will be refunded to the Member's account.

Qualified Members. RTI will provide Direct Communication Services to Qualified Members only. "Qualified" Members are those Members who have a current paid membership (Silver, Gold, or Platinum) and who have used a minimum of 1,000 credits throughout the duration of their membership.

NOTICE TO FNCs. HotRussianBrides.com secures and electronically stores an executed CA as well as any support documentation provided by Members. Additionally, HotRussianBrides.com utilizes the United States Justice Department's web site to check the National Sex Offender Public Registry and State Sex Offender web sites as per IMBRA requirements, and may perform other background checks as required by Maryland for Maryland residents or other checks as may be required by applicable law. AN FNC MAY REQUEST OFFICIAL CRIMINAL HISTORY RECORD INFORMATION FROM MEMBERS WHO RESIDE IN THE STATES OF HAWAII, NEW JERSEY, AND WASHINGTON. However, HotRussianBrides.com has no way of ascertaining the authenticity of any documentation, or how current the information or images are that a Member may provide. Further, HotRussianBrides.com does not verify the accuracy of the information supplied by Members on the CA, conduct independent individual or criminal background checks, or certify the information Members provide for their profile, including but not limited to, age and marital status. Therefore, RTI makes no warranty either express or implied that the information contained within a Member's profile is truthful and accurate or that a Member is available or eligible for marriage. RTI expressly forbids Members that do not meet the eligibility requirements contained in the "Lawful Use and Eligibility" section in this Agreement from becoming Members of the Website. Therefore, in addition to RTI's policy of reserving the right to deactivate any Member's profile and access to the Website with or without cause, RTI will not allow Members, of whom it has knowledge, that do not meet the eligibility requirements contained in the "Lawful Use and Eligibility" section, to participate in Website Services. However, RTI assumes no liability for any deactivation of a Member's profile and account due to information from any source that may incorrectly identify a Member as ineligible to participate in Website Services, whether the incorrect identification is due to electronic or human error. Additionally, RTI assumes no liability as a result of Members who supply false information or false or misleading documentation on the CA or within their profile. RTI expressly warns FNCs that undesirable individuals who supply false information and/or supply false or misleading documentation may gain access to Website Services. As a result, RTI, its affiliates, and their employees, officers, directors, representatives, and assigns will not be liable for any direct, indirect, exemplary, special, punitive, incidental or consequential damages arising out of an FNC's participation on HotRussianBrides.com or any RTI affiliated website, from events whose consequences may involve but are not limited to, financial loss, physical damages, bodily injury, and emotional distress.

NOTICE TO MEMBERS. HotRussianBrides.com secures and electronically stores the passports and any other documentation provided by FNCs, in order to validate the information contained within their profiles. However, HotRussianBrides.com has no way of ascertaining the authenticity of any documentation, or how current the information or images provided by an FNC are. Further, HotRussianBrides.com does not conduct independent individual or criminal background checks on FNCs. Therefore, RTI makes no warranty either express or implied that the information contained within an FNC's profile is truthful and accurate or that an FNC is available or eligible for marriage. RTI expressly forbids FNCs who have been convicted of a crime or are under the age of 18 from maintaining profiles and participating in the Services on the Website. Therefore, in addition to RTI's policy of reserving the right to deactivate any FNC's profile and access to the Website with or without cause, RTI will not allow FNCs of whom it has knowledge have been convicted of a crime or are under the age of 18 to participate in Website Services. However, RTI assumes no liability for any deactivation of an FNC's profile or account due to information from any source that may incorrectly identify an FNC as ineligible to participate in Website Services whether the incorrect identification is due to electronic or human error. Additionally, RTI assumes no liability as a result of FNCs who supply false information or supply false or misleading documentation to support the information supplied within their profile. RTI expressly warns Members that undesirable individuals who supply false information and supply false or misleading documentation may gain access to Website Services. As a result, RTI, its affiliates, and their employees, officers, directors, representatives, and assigns will not be liable for any direct, indirect, exemplary, special, punitive, incidental or consequential damages arising out of a Member's participation on HotRussianBrides.com or any RTI affiliated website, from events whose consequences may involve but are not limited to, financial loss, physical damages, bodily injury, and emotional distress.

All Members and FNCs participating in the Website Services assume all risks associated with using the Website, which may include but are not limited to, the possibility of being scammed for purposes of illegally obtaining United States visa status, the possibility of being financially or emotionally exploited, of being physically or emotionally abused, of being stalked, hurt, or harassed whether electronically through email and/or instant messaging, verbally, or otherwise, and, the possibility of incurring bodily injury up to and including death.

Given the dynamic nature of immigration requirements and policies worldwide, RTI assumes no responsibility or liability whatsoever with regards to the acquisition of any visa, immigration status, or other desired immigration objective that may or may not be affected by a Member's or FNC's participation in the Services provided on the Website. Therefore, RTI, its affiliates, and their employees, officers, directors, representatives, and assigns, have no liability whatsoever and shall be held harmless by all Members and FNCs against any liability with regard to any and all immigration matters that may or may not be affected by the use of the Services provided on the Website.

Safety Awareness. NOTICE: THIS WEBSITE DOES NOT CONDUCT CRIMINAL BACKGROUND SCREENINGS except as Maryland or other applicable law may require. The following are safety recommendations only. They are not intended to create a false sense of security or infer that observance of these recommendations will protect users from fraudulent activities or cyber crime. RTI hopes that Members and FNCs will use these recommendations as a starting point to develop their own safety protocols in the hope that so doing will promote a safe and enjoyable experience on HotRussianBrides.com. U.S. Export Controls. This Website is subject to U.S. Export Controls. Users may not download or use the Website's software if they are located in, under the control of, or are a national or resident of any country to or from which the U.S. has embargoed goods and services or any country that is on the U.S. Treasury Department's list of Specially Designated Nationals or the U.S. Commerce Department's Denied Persons List. The following list of countries, that may have U.S. trade restrictions currently in place, is only intended as a general guide and may not be inclusive or current: Balkans, Belarus, Burma/Myanmar, Cote d'lvoire (Ivory Coast), Cuba, Congo, Iran, North Korea, Somalia, Sudan, Syria and Zimbabwe.

Right of Termination. If RTI determines a user is in violation of this Agreement, at its discretion, RTI may terminate access to the user's profile and account immediately. Additionally, RTI may alter, suspend, or discontinue any user's access to, or alter, suspend, or discontinue any aspect of the Services in general at any time without notice. Further, RTI reserves the unrestricted right to terminate any user's profile, membership, and block any user's access to the Website at any time without notice or cause.

Users Login ID and Password. During the registration process, all users will create or be assigned a unique username and password that is associated with their account. Users are solely responsible for maintaining the confidentiality of their password, and are fully accountable for all activities that occur under their account. Users are prohibited from sharing their password with any third party and from using their password for any unauthorized purpose. Users may not assign or transfer access privileges to any other person or entity. Users agree to notify HotRussianBrides.com immediately upon learning of any unauthorized use of their password or any other breach of security.

Duration. This Agreement will remain in effect while users use the Website either as a Guest, Member, FNC, or Agency. Even after use ends, certain sections of this Agreement will still apply. Members may terminate their membership at any time by selecting the "Cancel Membership" link located within their "My Account" page. If necessary, other users may contact info@hotrussianbrides.com to terminate their accounts. Unused Credits that are present in Members' accounts are non-refundable and non-transferable. RTI reserves the right to terminate any user's access to the Website at any time. If a user is found in violation of this Agreement, access to the profile and account will be severed immediately.

No Use for Commercial Gain or Advertising. The Website is reserved for non-commercial use only. Organizations, companies, and businesses are prohibited from using the Services or the Website for any commercial purpose unless approved by and in cooperation with RTI. Said prohibition includes, but is not limited to, any person or entity surfing, trolling, or using any search method to identify participants on the Website (whether the participant is a Member, FNC, or Agency) for any commercial purpose or for any activity whatsoever which is not expressly allowed in this Agreement. In as much as it would be difficult to calculate the damages incurred by RTI in the event of violations of this no advertising or commercial use provision, all users and third party advertisers agree that they are subject to Liquidated Damages of at least $100.00 per each unauthorized contact of a Member, FNC, Agency, and/or any undefined user as well as all attorney's fees, court costs, and expenses incurred by RTI to enforce this provision. Notwithstanding the aforementioned, no specification in this Agreement of any particular remedy shall be construed as a waiver or prohibition of any other remedies available by law to RTI.

Exclusive Rights. The Website is operated by RTI. The content, visual interfaces, images, logos, button icons, interactive features, information, graphics, design, compilation, computer code, products, software, services, and all other elements of the Website that are provided by RTI (the "RTI Materials") are protected by United States copyright, trade dress, patent, and trademark laws, international conventions, and all other relevant intellectual property and proprietary rights, and applicable laws. RTI Materials do not include user-posted content or any other content owned by and submitted by users to the Website. All RTI Materials contained on the Website are the property of RTI or its subsidiaries or affiliated companies and/or third-party licensors. All trademarks, service marks, and trade names contained in the RTI Materials or on the Website are proprietary to RTI or its affiliates and/or third-party licensors. Except as expressly authorized by RTI, all users agree not to sell, license, distribute, copy, modify, publicly perform or display, transmit, publish, edit, adapt, create derivative works from, or otherwise make unauthorized use of the RTI Materials. RTI reserves all rights not expressly granted in this Agreement. Users shall not acquire any right, title or interest to the RTI Materials, except for the limited rights set forth in this Agreement.

Member Likenesses. Members grant, and warrant they have the right to grant, a license, including where applicable copyright and/or trademark licenses or sublicenses, giving RTI the right to use, copy, display, and distribute Member likenesses (Member likenesses being any images or audio of a Member in any form, format, or media, posted by Members on the Website) without limitation worldwide for perpetuity in original form or derivatives thereof or in combination with other content. Inherent in this grant by Members to RTI is the issuance of any licenses or documentation required by any jurisdiction worldwide that may be needed for RTI to exercise the rights granted herein, with any and all requirements of the governing laws and legal authorities having jurisdiction over said licenses or documentation, such as royalty free, pre-paid, sublicenseable, or any other requirements, fully satisfied.

FNC Likenesses. FNCs grant, and warrant they have the right to grant, a license, including where applicable copyright and/or trademark licenses or sublicenses, giving RTI the right to use, copy, display, and distribute FNC likenesses (FNC likenesses being any images or audio recordings of an FNC in any form, format, or media, posted by FNCs or their Agencies on the Website) without limitation worldwide for perpetuity in original form or derivatives thereof or in combination with other content. Inherent in this grant by FNCs to RTI is the issuance of any licenses or documentation required by any jurisdiction worldwide that may be needed for RTI to exercise the rights granted herein, with any and all requirements of the governing laws and legal authorities having jurisdiction over said licenses or documentation, such as royalty free, pre-paid, sublicenseable, or any other requirements, fully satisfied.

Security. Users and unauthorized third parties are prohibited from violating or attempting to violate the security of the Website, including, without limitation, accessing data not intended for such user, logging into a server or account which the user is not authorized to access, attempting to probe, scan, or test the vulnerability of a system or network, breaching security or authentication measures without prior authorization, attempting to interfere with service to any user, host, or network by means of a virus, or any type of denial of service attack, sending unsolicited email, including promotions advertising products and services. RTI is not responsible for the loss or misuse of any data or information that is obtained by unauthorized access or through the illegal acts of any user or third party. Violations of the system or network security may result in civil or criminal liability. RTI will investigate occurrences that may involve such violations, and may involve and cooperate with law enforcement authorities to prosecute users found guilty of such violations.

Acceptable Content. All users agree that RTI may review and delete any messages, photos, profiles, video, or any other material (collectively, "Content") that violates the "Acceptable Content Policy" defined herein.

All users are solely responsible for the Content that they post or transmit to other users while using the Services.

With any Content that users submit for posting in any public area of the Website such as the "Testimonials" section, users automatically grant RTI the right to use, copy, display, and distribute such information and Content without limitation.

The following Acceptable Content Policy defines the type of Content prohibited on the Website. This list is condensed and not inclusive of all Content forbidden on HotRussianBrides.com. RTI reserves the right to remove any Content similar in part or in full to that which is listed below, as well as any Content not mentioned below that RTI in its sole discretion deem inappropriate. Users who violate this Acceptable Content Policy may be banned from any current and future use of the Website. Unacceptable Content includes but is not limited to Content that: Content Disclaimer. All users understand that when using the Website, you will be exposed to content posted by users and other content from a variety of sources, and that RTI is not responsible for the accuracy, integrity, quality, legality, usefulness, safety, or intellectual property rights of or relating to such content. Users further understand and acknowledge that you may be exposed to content that is inaccurate, offensive, indecent, or objectionable, and all users agree to waive any legal or equitable rights or remedies you have or may have against RTI with respect thereto. RTI does not endorse any user-posted content or content provided by any other party, including advertisers, or any opinion, recommendation or advice expressed therein. Under no circumstances will RTI be liable in any way for or in connection with any user-posted or third-party content, including, but not limited to, any inaccuracies, errors or omissions in any content, any intellectual property infringement with regard to any content, or for any loss or damage of any kind incurred as a result of the use of any content posted, electronically mailed or otherwise displayed or transmitted through the Website.

Monitoring Users and Content. If at any time RTI chooses, in its sole discretion, to monitor any content on the Website, RTI nonetheless assumes no responsibility for the content, no obligation to modify or remove any inappropriate content, and no responsibility for the conduct of the user submitting any such content. All users acknowledge that RTI may or may not pre-screen user submissions, but that RTI and its designees shall have the right (but not the obligation) in their sole discretion to pre-screen, refuse or remove any User submission that is available via the Website. Without limiting the foregoing, RTI and its designees may, at any time and without prior notice, remove any user submission that in the sole judgment of RTI violates this Agreement or is otherwise objectionable. All users agree that you must evaluate, and bear all risks associated with the use of any user submissions or other content, including any reliance on the accuracy, completeness, usefulness or legality of such user submissions or other content.

Removal of Content. Notwithstanding any other provisions of this Agreement, RTI and its designees shall have the right (but not the obligation) in their sole discretion to refuse or remove any content that is available on the Website, in whole or in part, at any time for any reason or for no reason, with or without notice and with no liability of any kind.

Online Copyright Infringement Liability Limitation Act (OCILLA). This Website complies with the "notice and takedown provisions" in the OCILLA portion of the Digital Millennium Copyright Act. If you believe that your work was copied or posted on the Website in a way that constitutes copyright infringement, please contact the designated agent indicated below with the following information: RTI's designated agent for notice of claims of copyright infringement can be reached as follows: RTI Copyright Notices, P.O. Box 464, Dunedin, FL 34697. All information itemized above must be included in the notice to the designated agent or the notice will not constitute proper notice per the Digital Millennium Copyright Act.

Privacy Policy. RTI considers personal data to be confidential, and has developed a Privacy Policy outlining personal data collection and use. By using the Website, users are assumed to be familiar with, and agree to, the conditions and limitations in the Privacy Policy.

Copyright Policy. Users may not post, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information contained within the Website without first obtaining prior written consent from RTI.

Links. RTI or third parties may provide links on the Website to other sites or content ("Reference Sites"). Purchases. Purchases of Services on the Website can only be made using a credit card (Visa or MasterCard). A Member must be an authorized user of any credit card he utilizes to make purchases on the Website. Any processing or other transaction fees billed directly to a user's credit card, whether from the issuing bank or other entity involved in the processing of a user's credit card transaction, are the sole responsibility of the user. If any discrepancy appears between the name on a credit card and the Member's profile, a notice will be sent via email requesting an explanation for the discrepancy. Members will have to verify authorized use of the credit card in order to avoid deactivation of their profile. All purchases are governed and limited by the policies and procedures of RTI. RTI reserves the right to alter or discontinue any referral program at any time without notice. Receipt of referral rewards will be contingent upon various activity levels being met by the referred Members. Credits earned during a referral program will be awarded at the beginning of the next monthly subscription billing cycle. Any attempt by any user to earn referral credits by creating multiple profiles or by any other fraudulent means, may result in the immediate closing of the perpetrator's profile, the forfeiture without refund of any unused credits in the perpetrator's account, a permanent prohibition on the use of the Website and any affiliated RTI websites, and the possible prosecution of the perpetrator(s) to recover lost revenues as a result of the fraudulent activity as well as all legal, court, and administrative costs associated with the recovery. All users participating in a referral program are solely responsible for ensuring that their participation does not violate any third party agreements or rights. Any referral program is subject to all other applicable provisions in this Agreement and is void where prohibited.

Refunds. All users specifically acknowledge that RTI is not obligated to offer a refund on any valid, properly executed order for any Services. When Members send a letter and it is transferred to the intended recipient's inbox, this is considered a properly executed order. Letters that go unread or from which Members receive no reply are still considered properly executed orders and do not entitle them to a refund. RTI is not obligated to offer a refund based on any user's personal success (or lack thereof) when using the Website or the Services. Dissatisfaction with the Website or any Services offered within does not entitle any user to a refund. Nor are refunds issued due to any user's failure to familiarize themselves with the functionality of the Website, which may result in incorrect use of the Website. Memberships:

Incentives for membership upgrades are at the discretion of RTI and may be available or discontinued without notice. If available, incentives for membership upgrades are one time rewards only. A Member may not receive more than one incentive for a membership upgrade for any reason. Additionally, the benefits available with a monthly membership level are offered on a "per month" basis only. Any benefits available with a membership level, including but not limited to, the allotment of "Introduction Emails" and "Follow-Up Emails", are only available in the month for which they are allotted. A Member may not carry over unused Introduction or Follow-up Emails into a following month. Any unused benefits will expire at the end of the month in which they were allotted.

Membership Renewal Notice:
Automatic monthly membership renewals will take place each month on or about the anniversary of the date that a Member initiated a membership. If for any reason the renewal transaction is unable to be processed, RTI will make up to two additional attempts to renew the membership before any loss of privileges occurs with a Member's existing membership level. If a second or third attempt is required to renew the membership, the anniversary date for subsequent monthly renewals will become the date upon which the renewal transaction takes place. If after three attempts, the automatic membership renewal transaction has not been satisfied, the membership will automatically revert to the Bronze membership allowing the Member free membership level access to the Website without restricting the use of any available credits or disrupting the access to any "pay per use" services.

Gift Deliveries:
By using the Website or Services, users hereby acknowledge and agree that the purchase of any gift delivery service listed on the Website, and subsequent confirmation of delivery, constitutes value received. RTI specifically prohibits the solicitation of gifts by FNCs. However, RTI assumes no responsibility or liability for the actions, either online or offline, of Members, FNCs, or Agencies whatsoever. Force Majeure. RTI will not be liable for any loss resulting from a cause over which it does not have direct control, including but not limited to failure of electronic or mechanical equipment or communication lines, telephone or interconnect problems, computer viruses, unauthorized access, theft, operator errors, severe weather, hurricanes, earthquakes, natural disasters, strikes or other labor problems, or governmental restrictions.

Severability. In case any one or more provisions contained in this Agreement shall, for any reason, be held invalid, illegal, or unenforceable in any respect, such invalidity, illegality, or unenforceability shall not effect any other provision hereof and this Agreement shall be construed as if such invalid, illegal, or unenforceable provision had not been contained herein.

Governing Law. This Agreement shall be deemed for all purposes to have been entered into in the State of Florida. All users agree they are subject to the jurisdiction of the State of Florida and waive any right to defense for lack of jurisdiction. Venue for any and all disputes between a user and RTI, including, but not limited to, any claims for violation of any statute, contract, tort or common law, shall lie exclusively in Pinellas County, Florida or the United States District Court, Middle District of Florida, Tampa Division. RTI and all users agree to waive any claim for jury trial in any dispute between any party and RTI. This Agreement shall be governed by and construed in accordance with the Laws of the State of Florida.

Entire Agreement. The Agreement is the entire agreement between the user and RTI relating to the subject matter herein and supersedes any previous communications, representations, understandings, and agreements, either oral or written, between the parties with respect to said subject matter. This Agreement shall not be modified except as permitted by this Agreement. In the event a Member, FNC, or Agency enters into any subsequent agreement with RTI or one of its affiliates for any particular Services or pursuant to any future policies, procedures, rules, and/or regulations, the provisions of such subsequent agreement or policies, procedures, rules, and/or regulations shall govern only to the extent they are in addition to, or inconsistent with, the provisions in this Agreement. In all other instances the provisions of this Agreement shall govern.

To provide some services available through the Website, RTI purchases services from various foreign Agencies. Users may have the option to purchase some services directly from the Agencies. The Agencies providing services through the Website or directly to users are independent contractors and are not employees or agents of RTI. RTI is not responsible for the negligent or fraudulent acts of any Agency or its employees and agents. Further, RTI is not responsible for any Agency's failure to adhere to any policy, rule or regulation established by RTI regarding their conduct on and off the Website, or any Agency's failure to deliver any services in part or in full that are contracted directly by a user. Agencies are bound by this Agreement and additional terms (the "Cooperation Agreement") to conduct themselves and provide services in a professional and ethical manner. Each Agency is responsible for validating the FNCs they register on HotRussianBrides.com. However, all users acknowledge and agree that RTI is not responsible for the conduct of independent contractors and therefore, all users indemnify and hold RTI harmless for any misconduct by any Agency including but not limited to, violations of this Agreement, the Cooperation Agreement, or any applicable U.S., foreign, or international law. Additionally, RTI does not pay FNCs to participate on the Website and forbids any participating Agencies from paying FNCs they register to participate on the Website.
